Black birds are back by the hundreds .Shot at least 25 off the roof with the wild cat and another 20 in the barn when they roosted with the PRod.Sorry no pics to much poo to go round up bodies.
 
Only reason I ask is because the wife at a farm asked me if I'd shoot the black birds when I got a chance. When asked which black birds she was referring to, she pointed to some in a tree and said "those". Well, they were starlings.

And I couldn't tell from your pic. I've shot starlings, cowbirds, three different kinds of black birds, and grackles.....they're all black but all different too.

Iwas told at by a EPO at one of my permissions it was ok .Know I’m thinking I neeneed to check into this a lot further.Bob where would one get a federal premltt if needed ?

Yes Blackbirds are protected by federal law $15,000 fine and up to 6 months prison. In my state OK. you can only hunt crows with a shotgun using non lead shot.

Hunting crow and taking them because of depredation are two different things. If crows or blackbirds are destroying your property, crops or pose a health hazard, Federal Law says you can take them, unless your state specifically prohibits it, with a firearm using non-toxic ammunition or an air gun using lead pellets and you don't need a permit to do so however you are required to submit an annual report the FWS. You are supposed to use non lethal methods to control depredation before you resort to shooting them.
 
outdoorman is correct about the non-lethal means. When the farmer asked me to shoot crows (in his corn fields) out of season last fall, I looked up the law and told him that non-lethal measures needed to be taken first, like loud noises or recordings, nets, flags, etc.

He responded by saying, "Yeah I did all that". I don't think he did but who am I to ask him for proof. I told him his property would/could be subject to inspection at any time and he said no problem.

Before I started shooting I put up an owl decoy and also fired shots into the ground to scare the crows away but neither of those things worked. The corn was like a magnet to them.

I proceeded to shoot them for the next month and never had any contact from police or other officials. I sent in a report as required and never heard anything from it.
