Bad Vendor experience, what would you do?

I bought a HW44 new (May 2019) from _ _, and it has been an utter failure.

3 times it has had a major air leaks from around the magazine opening. The first time I sent it in they apparently had to remove the "fixed" moderator, and it came back scratched with a couple extra set screws.

200 shots later it is leaking again. I send it in and mention the moderator seems a little loose. It comes back "repaired" with the moderator EPOXIED on. The included note said the tech had replaced the transfer port oring. It started leaking again after 60 rounds. A few more shots and it is blowing air big time.

I call _ _, who directs me to _ _ tech support. Stacy says it sounds like a mechanical problem with the transfer port and maybe a merchandise credit could be arrainged. She sends me a Fed Ex return label.

I send in the gun _3 weeks ago_ with all the accesories that came with it, and a letter explaining I would preferr the credit and not a new gun. It seems like I was placed on a "DO NOT COMMUNICATE WITH" list as I have not been able to talk to anybody since.

I did not get an email acknowleding the acceptance of the gun, but Fed Ex did confirm delivery. I have left 5 voice mails after the usual "we're busy, leave a message, we will answer ASAP", and more than 5 emails to Toni, with the same we'll get back to you lie. _ _ will also not answer, as they are too busy. The messages I leave are NOT rude or accusatory in any way.

I'm ready to call my State Attorney and claim internet trade fraud or theft.

Going to court over an airgun leaking? Lol..I don't think it's worth the time and money. You lose more money hiring an attorney than gaining anything from it. Air leaking is a part of all pcp. No matter what gun you buy, there will always be air leaking in these pcp sooner or later. Even high end guns like the fx impact will have leaks. That's why you learn how to fix them..they are simple as replacing few o rings. Not hard. The hard part is finding where the leak is. Some leaks are so small it's hard to find the leaks. Once found it. It's easy fix. If you aren't into repairing your own pcp. Maybe I suggest break barrel.

Maybe there is some language barrier. The OP did not say one thing about going to court. Also, he explains how he had a new gun with more than one problem. After sending the gun in for the third time, now he has nothing. No gun, no refund and the vendor will not respond to his phone messages, nor will they accept his calls.

Sounds to me like the OP has a legitimate beef. Only flaw in the OP's actions is that he didn't identify the vendor, so those who find this behavior unacceptable can avoid him.
 
Have you left a msg. stating the# of calls & messages you left, the amount of time that's passed since you've heard from them and, LASTLY, if you don't hear from them in 1 week(or whatever you decide is appropriate) you'll have to take whatever action you need to take to benefit YOU. If you don't hear in the stated amount of time DO WHAT YOU GOTTA DO! 

Document all attempts at communicating! 
 
I think that's a pistol?and its over a $1000 dollars" man i woulds be pissed" to say the least" dam just try to get your money back" i stick with the lower end pcp's dont seem to have any trouble"If the guy advertises on this forum?get a hold of the owner of this forum Michel i think he's the leader of this battalion here, and he will look into it"

He said is ready to call his state attorney. Idk cause state attorney deals with crimes in their state. I think he mean his own attorney and not state attorney. You don't hire an attorney if you're not going to court. One thing op can do is ask for a refund. Or have his bank cancel or refund his money. Not take it to court. No gain from it.
 
I didn't name the well known vendor, because I didn't want to accuse an advertising vendor of this site, on this site. The State Attorney is exactly as it seems. The attorney general of the state you live in. They "can" represent citizens of their state against things like internet (out of state) malpractice in some cases. That's an extreme situation.

What do you do if the place you sent your AG back to for repairs/returns WILL NOT return you calls/emails or even admit they have your AG in their possession???

I'm just really pissed off that PA has not had the courtesy to address my issues. A simple "we're working on it" would do. But no, nothing. Really??? Over 3 weeks: The "your call will be addressed in the order it was received" is BS. I'll try calling the "Order Product" line next week, I'll bet I can through there. But I'll be routed to AV tech support and get the same "customer disservice" dead end cr_p.

I've spent, over several years, almost $5,000.00 buying their products. In all that time I've only sent 2 in for repair. One was a Beeman R1 that broke a spiring after 4 months. They fixed it and I was happy. It broke again several months later and I fixed it myself with a Vortek spring kit, no problem. There was one other return for repairs, and again no problem. I have never asked for a return on a product or hasseled them in any way.




 
That truly sucks. I have had similar experiences, and it is a tremendous frustration, as there is very little you can do. Meanwhile, the seller has both your product and your money. I was once about ready to make a very long drive to wait at a vendor's door and have a personal discussion, but I finally received a response. I doubt if the state AG office will be of much value, but I suppose you could try. If not too late, a disputed charge with the cc company might be effective, as that may result in a charge back to the vendor's merchant account by its bank. Given the amount of time involved here, I guess the terms of your card agreement might determine if this is an option. I'm reasonably sure you can dispute the charge, but, as it has probably been paid by your bank, I'm not sure if the charge back to the vendor's account can be requested. You might try leaving a message that briefly describes your plan of action, doing so as unemotional as possible, making it clear that the vendor's lack of response has left you no choice. Hopefully, this thread alone might offer some incentive to PA, as others will definitely be influenced by the poor service. As you mentioned, it's not just the quality of the repair service at issue, but the lack of communication, which is inexcusable.
