It is illegal to sell stolen property. Period. No if's and's or but's. I'd notify the post as well as they'd be very interested to know what happened to property they were responsible for.
Taking this one step at a time because first goal is getting Kdog moolah. After eBay and PayPal make their decision we’ll go from there. Sometimes justice is served when they close down accounts etc… notifications to post master and Alphabet org are maybe’s at this point.
 
maybe's ? was the missing, possible thief reported? when it first was missing? to not follow up to law enforcement, might, maybe, could be,,, accessory after the fact
Knowledge of a crime and NOT reporting it , is a crime in my state. Had a judge explain it to me. It was not a free explanation.
I did not break any other laws, I just had knowledge of it happening.
I am all for Kdog getting paid,

but what about the next victim? the criminal will not stop on his own volition.

Do what you will, but, yeah I'd be doing everything possible to put a stop to the thief. Whether they're related to the seller or not.
 
Just a question here because I’m not sure I really understand the whole situation. If the eBay seller happened to have purchased it for example on eBay, they would be no different than the op. What is saying at this point the op is not in possession, knowingly at this point, of stolen property?

OP contacted seller immediately upon inspection of ser# and then notified seller and eBay and PayPal - that’s a big difference plus OP has line of custody documents from original sale to point of loss. OP was acting to recover property not profit from it.
 
What happens if no money is ever recovered? Who actually owns the property?

That is a really good question. It’s a weird situation for sure. The OP has paid for it again not realizing it was the same gun until it arrived. I mean it’s his at this point and unfortunately the original guy will just be out. I think that is what will happen. We live in an age where in so many places the police don’t even police theft in their own cities and jurisdictions. I can’t imagine anyone will jump about this whatsoever.

I guess I missed something. So the original seller reimbursed the original buyer when the gun went missing right? Didn’t the post office ever reimburse the seller for losing it or wasn’t it insured?

I usually charge a little more for shipping to cover insurance when I sell something. I pack extremely well, so it's more for loss during shipping, which over the past few years seems to be happening a lot.

It's amazing at how many balk at paying an additional $5-$10 to cover the item they purchased though. Of course then they balk that I charge too much for shipping. :unsure:

As a buyer it is almost better to just do it yourself. I did that recently with an item. Just had the seller send me package dimensions and weight. I then used pirate ship to purchase a pre paid label and sent it to him as a pdf. That way I know it’s insured and I got the cheapest price possible.

I think a lot depends on PayPal and eBay’s decision and most importantly if Kdog wanted to pursue the eBay seller and attempt to press charges etc… very difficult to pursue this, that’s why we’re hoping PayPal and eBay stand by their policies.

Answer is no - it was a total loss to the original seller. Thus the desire to get him compensated

You might want to check pirate rules concerning airgun/ insurance. Probably not covered when using a discount shipping party - FedEx although twice the amount is golden.

So... Kdog refunded you...and ate the rifle. To make things right with you....and you alone. when he infact did not have to. At all not one bit... He didn't owe you a thing. Correct! That is definitely a Stand up guy..!!! Now that you know the truth "know the truth" and that it is infact his rifle... Your waiting on eBay and PayPal to decide on a refund... So let's say... The eBay/PayPal thing doesn't work out... Who's gonna be the stand up guy?

I don’t see it that way. If I buy an item from you I am your customer and there is some sort of agreement or contract implied you will get the item to me. If the shipper (that you are a customer to…with same agreement/contract ) loses it that isn’t my fault. It’s up to you the seller to make good with me. When it comes to reimbursement from a shipper that reimbursement goes to the person that sent it not that was supposed to get it as the receiver isn’t their customer the person that shipped it is. So it’s the responsibility of the seller to make it right with the buyer irregardless. They owe it to them. As it’s the responsibility of the shipping company to make it right with their customer who paid the bill to send it. This is why I never agree when sellers want extra money to insure something. The responsibility is on you not the buyer you should just do it as sound business practice. I don’t know maybe I’m crazy but this is how I see it and I hope my explanation attempt made sense.
