Please ask a maker if you do NOT understand something.

In answer to liability, if someone buys a part for their car and does not understand how to fit it and buggers it up and still installs it, is the part maker responsible if it then fails? It is expected when you buy a part for your car that you have the knowledge to install it, When you buy a shroud or moderator from me it is understood that you have the basic intelligence to know how to screw it on or slide it on and then use a set screw to tighten down on it. How can any maker be 100% certain that the customer will not ignore the instructions and make alterations to the part because they have not read the instructions? Really guys the shrouds and LDC's I make are the easiest to install, do makers of soda bottles give instructions on how to unscrew the top? I may have to get customers to sign a disclaimer that they know how to install what I am making for them on their gun and that any modifications they make to them will void any warranties and remove and responsibility from me if the part fails because of those modifications? 
 
The hot coffee thing has me worried, we all know coffee is hot yet the woman still managed to sue the company for millions of dollars for the burns she received. I am amazed at some of the stupid things the courts make rulings on, it is no wonder people are so worried about being sued over here. Not trying to go political here just saying with the coffee law suit I am a bit more concerned about liability than I was before, Neil.

I would suggest that you have a signed disclaimer in hand before shipping your shrouds. A huge indisconvience for you and your customers, but that is society today.
I ordered a trigger upgrade for my Bennie Trail 1500 from the Tuna guy. By the time I got done jumping through the hoops to order from him I felt entirely intimidated, but at the same time I felt a lot of confidence in the both of us. You can tell he has seem much stupid stuff when dealing with the public. Kinda funny in a way to read his "how to order" section on his website. Just my 2 pennies worth.

Don't want to get off on a tangent, Neil, but the good news is that the "coffee suit" was later overturned. I think local juries see a big corporation like McDonald's as a money pit and try to give "their" money away, never realizing it's really our money paying for their hamburgers and egg mcmuffins that they're wanting to give to the "poor victim." Not a lawyer but worked in the employment law arena most of my career and most cases come down the "reasonable and prudent" assessment. Perhaps pay attention to your installation sheets (they're not an afterthought but an integral element of your product) and encourage customers to contact you for assistance if confused and you should be fine. And go out and shoot more (but not your customers no matter how tempting :) ); always helps me.
 
So I do not insult every customers intelligence I think I will tell all of my customers that if they need instructions on how to screw on or otherwise attach their LDC or shroud to please contact me before trying to install it. I just can not get my mind around someone who can not figure out how to slide a sleeve inside the frame of his gun and yet he feels qualified to make hokey brackets to attach a precision made piece to his gun. I will have my web site altered so that it covers this and also for new customers make sure they are totally capable of installing a shroud or LDC before I make it for them. I know I will not hear the end of this from this particular customer, I have already got the blame from him for his NOT reading my instructions and butchering a well made shroud, and in his e-mail he said butchered, really you think just adding 2 plates and 4 x 7/32 rivets is butchering it? He still apparently does not grasp that that sleeve is accurately machined to slide into the frame of the gun to align the shroud and barrel, yes I think it is butchered. Some of you are right it looks like I will have to do more to cover my tail against stupid! I hope you all have a wonderful and safe Xmas, Neil.
 
The last time I bought a push lawn mower. It literally said on the safety tag " not to be used on hedges". Really? but yes some idiot probable cut a limb off trying to cut his hedges with a lawn mower. I would highly recommend you have a some form of release that they sign on your website that you are not liable if used or installed improperly. In my business I have patients sign informed consents on many procedures. I have all of my dentures patients sign a form that they approve the color and shape of the teeth and there would be a charge to change this after it is processed. They make sure they look twice! Since I have had patients sign this form over 10 years ago I have yet to have a remake due to shape or color of teeth.
If you have them sign a release they will make sure it is installed properly

Thanks I will do what you say via e-mail and save all of them in a special folder. My web site was designed for me by a customer and every alteration requires I contact him and have him make changes. If I had more free time I would design my own site and run it myself but I just do not have the time. I like the idea though, I just hate to treat my customers like they are all idiots, but you are right, in this country of sue and get rich quick you have to cover your tail.
