I'm Still Stuck In NY. Any Attorneys In AGN? Need Advice On Adding An LDC

From what I gather here on supressors and forgive me if I'm wrong, but they are illegal in NY even for airguns if it can last a single shot with a center fire round? I wont be out of NY probably till the Spring and I'd like to shoot my Evanix Max 357 buts it's too loud. Any advice on the law and a can to make it as quite as possible is much appreciated.

You don't own a suppressor you own a Moderator. It may make a difference, but I'm not sure.

You can call it a pipe end ice cream cake for all it matters. IF the government decides that airgun suppressors are illegal the name used on a forum doesn't and won't make a difference.


+1 Never did understand the anal retentive way that such discussions were handled over in the "Gated Community". Almost puts me in mind of looters being called "mostly peaceful protesters".

That said a Google search (worth what you paid for it) on the use of suppressors in NY states they are illegal for firearms use. A second search to determine if an airgun is a firearm returns information that suggests an airgun is not a firearm in NY. I'd talk to a police officer, before a lawyer simply because that is who you are going to be talking to if someone complains.

The Google search says its illegal to possess a silencer/ suppressor that's removable in NY. I asked here, just seeing if anyone had experience with engagement with the law on one. One of the first posts I read on AGN 8 months ago, was, about this issue. From what I took away from the hour or so of reading the comments was that if it holds up to one round of a center fire round then its enough for a conviction but I haven't found any court decisions on it yet. 

Just curious. Not a big deal. 
 
This is an excerpt from a post that I asked Michael if it was ok to post.... In the same manner as getting answers for a felon you should follow the same steps on finding out if you can order and possess a moderator for your airgun in your city- county- state just change the topic from if its ok for a felon to having an air rifle with a moderator 

First for those that want to know if it is legal for a felon to own an air gun, in whatever state, city or parish.

If you are still on paper ( parole or probation) then your direct contact is your Parole/probation Officer 

It is understandable to reach out to other people involved in the air gun sport for answers but when it comes to the legalities you are searching the wrong resource. 

1. Start with your County Public Information Officer, They are usually Part of the Sheriffs office many times you can actually talk to them on the phone and you can ask questions but no matter what you need to ask who do you as a civilian write to too request a clarification of state laws regarding an convicted felon owning and shooting air rifles for hobby, sport and hunting. GET AN ADDRESS FOR WRITTEN CORASPONDENCE Get your answers in writing, its ok to ask on the phone but your final goal is to get the answers in writing

2. Follow through with that letter and be specific with your question if it is one that has not been asked before then most likely what will happen is a Clarification Request will be sent to the Attorney General office for research, Unfortunately the general public cannot ask them directly but many offices has those Attorney Generals research answers in search format on the government website. 

Understand that there is a chain of structure in the government and by starting with your local county you will insure that you are not only legal with the state but also the county you reside in. Yes it is slow but your answer will be legitimate and most important of all it will show due diligence on your part if an issue ever does crop up. Understand that this is only for your State if your go somewhere else it will not apply to that states lows. This is the only way you are going to get an answer that you can depend on and that will show due diligence on your part in a court of law. 
 
So after a call to the Alphabet org then the NY SAFE ACT, 855- LAWGUNS, the only suppressor aloud on an air gun is one that's built in from the factory or one that's purchased with one that's permanently affixed on prior to purchase. You can fight the charge of an add on suppressors saying it can not hold up to a center fire round with the federal government getting involved on the prosecution side. So, the short of it, possessing a removable AIRGUN LDC, silencer, suppressor, in NYS is indeed a felony. 

Tennessee is looking so much better each day.

If I am reading what he wrote correctly, he called them. Maybe you should call them to confirm? I'd expect any link they gave him would point to a legal citation. Interpreting that would lead you back to the start of that circle. There was a long post above which gives you the best practice in checking legality if you really need to do that.
 
A suppressor of any kind, even built for an airgun only, even with it's own proprietary thread is a felony to possess if it wasn't affixed permanently to the gun PRIOR to the purchase, is what NYS and Alphabet org is telling me as of 9am est today. I did not ask for the statute but here are their numbers if your are losing sleep, L.Leon.
