I think you're right. I always order on the phone because their website doesn't have live stock so even if you see it online it could be out of stock or back ordered.

Some stated have reciprocal taxing agreements which means you pay sales tax because your legislators have made an agreement with another state to tax you as well as their citizens and visa versa. Typically each states laws require a person to report and pay sales tax on items purchases out of state that did not have sales tax collected at the time of sale. It is indeed rare that anyone will actually "report" and pay though! ;)

Some years ago I moved to Washington State from New Mexico. I had a boat paid off I purchased in New Mexico and Washington State told me I would have to pay sales tax on the boat (again since it was paid in NM) to register it. I told them I would just sell it and to forget registration. They waived the repeat sales tax in order to receive the registration money.

Wow! That's illegal where I live. The law requires you to pay sales tax but if you bring proof of purchase showing it was paid out of state then the tax is waived. This is done to prevent people from crossing state lines to places like New Hampshire to avoid sales tax and then bringing them back to their home state for use.

Taxes are as inevitable as death. But it isn't the taxes per se I object to. Rather, it is the over-reliance on taxes to pay for everything government. What I want to see, is some tax-supported entity say something like.... We've renegotiated our contracts with (insert name) saving tax payers millions! I am not laying awake waiting, however.

Yes you are right

On June 21, 2018, The United States Supreme Court ruled 5-4 in South Dakota v. Wayfair that states can mandate that businesses without a physical presence in a state with more than 200 transactions or $100,000 in-state sales collect and remit sales taxes on transactions in the state. This decision overturned the Court’s 1992 decision in Quill v. North Dakota and 1967 decision in National Bellas Hess. Since the decision was handed down by the Court, states and retailers alike have been asking “What’s next?”

According to the Court’s majority opinion, the South Dakota law did not have an unreasonable burden on retailers because of the following:

  • It is not retroactive, meaning South Dakota can’t look back and require collection and remittance of sales and use tax on previously purchased items.
  • Only merchants who have a considerable amount of business are required to collect (according to the South Dakota law in question that means $100,000 in in-state sales or over 200 orders in the state).
  • South Dakota is one of 20 states that have adopted the Streamlined Sales and Use Tax Agreement, which provides certain standardization within the sales and use tax statutes “to reduce administrative and compliance costs” for remote sellers.

In my humble opinion, this was a careless decision by SCOTUS as it seems the High Court was focused on Amazon and Wayfair whilst ignoring the difficulty this would be for a small online retailer collecting and filing sales tax returns in so many different states. It was equally selfish by Wayfair to take this to court. Amazon had negotiated a tax collection solution with California long before this went to court and both parties were satisfied. Wayfair could have done the same with South Dakota.

My guess is in the future states will lobby to have all transactions taxed based on the destination, sales will be tracked through electronic payments. It's really just a manner of time
